When will I get the activation key and in what form?

LONGINT – IT company, Paweł Pelc with its registered headquarters in Wrocław, ul. Wykładowa 17 A, hereinafter the Software Manufacturer

and

The activation key is usually sent to an e-mail address of the buyer after the payment comes through. When paying for the program via bank transfer, it is best to give your e-mail address in the transfer name field. We can also send you the activation key via SMS.

Is it possible to receive a VAT invoice with deferred payment?

The Buyer of LoMag Software - natural or legal person or organisational unit with no legal personality, which has installed LoMag - hereinafter the Buyer.


§1

Subject of agreement

1. The subject of agreement is a licence for the use of software called LoMag granted to the Buyer by the Software Manufacturer and a determination of the terms of use.

YES. Please make a note of it in the remarks to the order. After receiving an order we send the original and a copy of the invoice to the Buyer via traditional mail. After we receive a signed copy of the invoice, we send the activation key to the full version of the program.

2. Upon acceding to the agreement the Buyer accepts the content of the licence

Can I transfer the program and the activation key onto another computer?


§2

Types licence

The program bay be used basing on the following types of Licence:

YES. The activation key is ascribed to the database. You must install the demo version on the new computer and then restore the database.

What if the key is lost, e.g., as a result of a computer breakdown?

a) DEMO licence - it is a fully functional version of the program, which may be installed and tested on any number of computers. This version is time-limited and it stops working after 30 runs.

You can retrieve your activation key from the program manufacturer. A request must be sent from the e-mail address to which the key was sent, together with the name of the company for which it was generated.

Can I resell LoMag or give my key to someone else?


§3

Term of licence

1. FULL licence is given for an unlimited period of time.

2. DEMO licence expires after 30 runs.


§4

New versions of the Program

NO. The activation key is SECRET ascribed to the Buyer and dedicated only to the Buyer. The distribution of the key or making the key accessible to third parties is severely prohibited.

How long may I use the DEMO version?

The DEMO version may be launched 30 times. It is a fully functional version of he program created for you to familiarise with the functionalities of LoMag free of charge and without any risk

Does the DEMO version operate in a network?

The Buyer has the right to download and use the new versions of the Program, to which the licence pertains, for the period of 12 months from the date of the conclusion of the agreement. New versions will be published on https://www.LoMag.pl. After the expiration of 12 months, the Buyer may keep the version they are using at the moment or buy the right to updates for the next 12 months.

Can I continue to work on the data I entered in the DEMO version?

YES

What is the difference between the DEMO version and the full version?

There are no differences in the functionalities of both of the versions. The DEMO version is time-limited and stops working after you have run it 30 times.

Does the program have any limitations, e.g. the number of warehouses, items?

The Buyer may use the Program simultaneously on several computers connected by an internal or external network, their number depending on a number of computers for which the licence has been purchased. The Program checks the number of simultaneuosly active computers connected with a network and warns if the number of available computers has been exceeded.

Prohibited actions

1. The Buyer is prohibited from:

- Distribution of the key or making the key accessible,

- copying the Program both free of charge and for payment,

- lending, letting, leasing, re-selling, transfer of ownership of the Program to third persons,

- distribution and making the program available in any form without a written consent of the Software Manufacturer,

NO. The program supports any number of warehouses, items, accounts, documents. The program has been tested on thousands of elements. Only the size of the Microsoft SQL Express database, i.e. 10GB, limits the amount of data. In practise this stands for many MILLIONS OF ENTRIES. There is also a possibility of buying a more advanced version of Microsoft SQL Server: Standard and Enterprise, which does not have limits as regards the size of the database.

Copyright

For the program to work in a network the computers need to be connected with a local network or VPN. Select "This computer is a server" in the Program/Settings/Networking on the computer which plays the role of the server and remember the name of the server which is displayed below. Select "This computer is a client and it connects with the server" on the remaining computers and type in the name of the server.

LoMag is protected by the copyright and neighbouring rights regulations in force, as are all its components. The Software Manufacturer is entitled to all legal titles and copyrights regarding LoMag (including the rights to the program, all graphic marks, trade marks, logos, images, photographs, audiovisual compositions, texts as well as the attached printed materials).

What to do if the program cannot connect with the server?

Limited liability for damage

  • Check whether an antivirus program or a firewall does not block the traffic between the computers. In some networks you will be asked to give the IP address of the server instead of the name of the server.

    • 1. The Software Manufacturer is not liable to the Buyer for the usability of the Program for the Buyer's individual purposes; it lies within the Buyer's interest to familiarise themselves with the possibilities offered by the Program in the demo version.

  • The computer which plays the role of the server must have the following tcp ports open: 1433 , 1434, 445 as well as udp: 1434
  • Check whether you can connect to the server by browsing through the network neighbourhood or find the computer by going to "Start/Find/Computer in a network".

    • 2. The Software Manufacturer is not liable for any damages indirect and/or direct connected with using the Program Package or connected with the impossibility to use it. Any possible claims of the Buyer shall be limited to the amount paid for the purchased Program Package.

  • Launch "PING serverName" from (Start menu/Launch/cmd). If the result is "Request time out" it means that the network is not active (e.g. the cable is not connecting).

Issues and Technical problems

Where is the data entered to LoMag stored?

3. Due to the edition cycle, the Instructions may bear some inaccuracies or may not include the newest changes in the software. The content of the Instructions or the documentation cannot be the basis of any claims against the Software Manufacturer.


§ 9

Resolution of disputes arising from the contract

The program saves the data in the SQL database in 2 files on the drive in the sub-folder "Baza danych". Usually the data files are located here:

  • c:\Program Files\LoMag\Baza danych\firma.mdf

    • 1. We not accept returns of the license keys as they are assigned to the customer indicated in the order.

  • c:\Program Files\LoMag\Baza danych\firma.ldf

    • 2. The parties shall attempt to amicably resolve any disputes arising out of this contract.

All the data and program settings are located in those two files. The files may be copied only if the warehouse management program is closed.

How to move the database to another computer?

3.  In case amicable resolution is not possible, the disputes shall be resolved by a court with jurisdiction over the place of the Software Manufacturer's business activity.

  • 1. menu Program / Backup database (on the old computer - server) and point the USB key to create a copy of the database.
  • 2. menu Program / Restore database (on a new computer) and point to a USB key with a copy of the database.

    • 4. The Software Manufacturer undertakes to keep the Client's data secret. Provided that the Client has not restricted this in writing, the Manufacturer may publish the name of the company and its headquarters on the LoMag client reference list.


    § 10

    In any matters not governed herein, the relevant provisions of the Civil Code and the copyright and neighbouring rights regulations shall apply.

    These general terms and conditions are applicable since 1 January 2018.
